RE: The tariff classification of women’s woven apparel from India

Dear Ms. Malina:

In your letter dated August 14, 2006, you requested a classification ruling. The sample will be returned, as requested

Style 179684 is a women’s woven hip length shirt-jacket which will be imported in sizes 1X-3X. The unlined garment is made from 98% cotton and 2% spandex fine wale corduroy fabric. The shirt has a pointed collar and a full front opening with six button closures. The shirt features long sleeves with button cuffs, two pockets with flap and button closures below the waist, front and rear yokes, a rear vent and a hemmed bottom.

The applicable subheading for style 179684 will be 6211.42.0056, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, women’s or girls’: of cotton: blouses, shirtsexcluded from heading 6206: other. The duty rate will be 8.1 percent ad valorem.
