RE: The tariff classification a woman’s knit garment from China.

Dear Ms. Schaeffer:

In your letter dated August 10, 2006, you requested a tariff classification ruling for a woman’s knit garment on behalf of Ann Taylor, Inc. The submitted style will be returned to you as requested.

The submitted item, style 155160A is a woman’s jumper constructed from 100 percent cotton knit fabric. The jumper has a deep, wide, V neckline that extends to the waist, short sleeves, and a tubular knit bottom.

You indicated that the garment should be classified as a dress in heading 6104. The submitted garment does not provide sufficient coverage to be worn without another upper body garment, a requirement of a dress. Therefore, the garment is classified in heading 6114 as a jumper.

The applicable subheading for style 6s829 will be 6114.20.0015, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of cotton: jumpers. The rate of duty will be 10.8 percent ad valorem.

The jumper falls within textile category 359. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
