RE: The tariff classification of knit shawl from China.

Dear Ms. Giang:

In your letter dated August 8, 2006, you requested a tariff classification ruling. As requested, the sample will be returned to you.

Your submitted sample is a knit polyester fleece shoulder wrap. The shawl measures approximately 88 inches in length and 22 inches wide. The shawl has a satin edging and the bottom of the shawl has pockets.

The applicable subheading for the shawl will be 6117.10.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up clothing or accessories, knitted or crocheted; knitted or crocheted parts of garments or clothing accessories: shawls, scarves, mufflers, mantillas, veils and the like: of man-made fibers, other. The rate of duty will be 11.3 percent ad valorem.

The shawl falls within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
