RE: The tariff classification of a polypropylene plastics coated textile fabric, for use in the manufacture of bulk containers for holding vegetables, etc., from China.

Dear Ms. Lengert:

In your letter dated August 2, 2006, on behalf of Super Poly Limited, Edmonton, Alberta, which was a follow-up to an earlier inquiry where we requested additional information, you requested a classification ruling.

The instant sample, which was not identified as to style or quality number, consists of a woven material composed of polypropylene plastic strips which measure not over 5 mm in apparent width, and, as such, are considered to be textile man-made fibers for tariff purposes. This material has been coated/laminated on one side with a blue pigmented, polypropylene plastics film, which is visible to the naked eye. You state that this material has the following composition by weight:

Wt. Of PP woven strips: 60%
Total: 100%

The applicable subheading for the product will be 5903.90.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for textile fabrics impregnated, coated, covered or laminated, with plastics, of man-made fibers, not over 70 percent by weight of plastics. The duty rate is 7.5 percent ad valorem.

This merchandise falls within textile category designation 229. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
