RE: The tariff classification of a hanging organizer from China

Dear Ms. Whitley:

In your letter dated August 4, 2006, you requested a tariff classification ruling.

The submitted sample is a hanging organizer that is identified as a “Scrapbooker’s Storage Tote.” You state that it is mainly used as a closet storage organizer to store scrapbook tools and embellishments in the closet. It measures approximately 27½” x 16” and has fourteen removable inside zippered pouches that are secured with hook-and-loop fasteners. The item can be zipped shut with a zipper that runs around its outer edges. The organizer features a hanging hook on one end and woven textile fabric carrying handles on both ends. There are three zippered pockets on the exterior. You indicate that it is constructed of 68% polyester, 17% cotton, 5% polypropylene, and 10% steel.

The applicable subheading for the storage tote will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up articles, other. The rate of duty will be 7% ad valorem.
