RE: The tariff classification of snowflake Christmas tree ornaments from China.

Dear Ms. Dias:

In your letter dated August 3, 2006, you requested a tariff classification ruling.

The submitted sample is identified as a snowflake ornament, item number 2143. The snowflake measures 3” x 3-1/2” and it is beaded with blue and clear acrylic imitation jewels. The snowflake ornament has been sprayed with a clear lacquer. A blue organza ribbon is attached for hanging the snowflake on a Christmas tree. Your letter of inquiry states that you intend to market this item as a free gift with the purchase of three other items from your product line.

The applicable subheading for the snowflake Christmas tree ornament will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free.
