RE: The tariff classification carrying case and accessories

Dear Ms. Pinter:

In your letter dated July 28, 2006, you requested a tariff classification ruling on behalf of Five Star Fragrance Company of Deer Park, NY. You have submitted a sample of a carrying bag, a mesh body sponge, a plastic spray bottle, and a molded plastic storage jar.

The carrying bag is wholly made up of a sheeting of plastic. It features two carrying handles and a zippered top opening. It measures approximately 8” (W) x 7” (H) x 1” (D).

The applicable subheading for the carry bag will be 4202.92.9060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other containers and cases with outer surface of sheeting of plastic. The rate of duty will be 17.6% ad valorem.

The applicable subheading for the plastic spray bottle will be 8424.89.7090, HTSUS, which provides for other mechanical appliances for projecting, dispersing or spraying liquids. The rate of duty will be 1.8% ad valorem.

The applicable subheading for the extruded mesh body sponge and the molded plastic storage jar will be 3924.90.5500, HTSUS, which provides for tableware, kitchenware, other household articles and toilet articles, of plastics: other. The rate of duty will be 3.4% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
