RE: The tariff classification of tote bags from Hong Kong

Dear Ms. Brown:

In your letter dated August 1, 2006, you requested a tariff classification ruling on tote bags. Style numbers were not submitted. This office is retaining one of the tote bags as an official sample. The remaining four samples are being returned to you, as requested.

The five submitted samples are tote bags designed to contain clothing and other personal effects during travel. Each of the five tote bags is constructed with an exterior surface of man-made textile fabric. Each tote bag features one large storage compartment with a zippered closure, and several inside pouch pockets. Three of the totes feature one carrying handle. The remaining two feature two carrying handles.

The applicable subheading for the tote bags will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides, in part, for travel, sport, and similar bags, with outer surface of textile materials, of man-made fibers. The rate of duty will be 17.6% ad valorem.

HTSUS 4202.92.3031 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the "Textile Status Report for Absolute Quotas" available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
