RE: The tariff classification of carry bags from China

Dear Ms. Jewett:

In your letter dated July 19, 2006, you requested a classification ruling for carrying bags. Your samples are being returned as requested.

You have identified the three submitted samples as SnapSacks. The three items are carrying bags with an outer surface of man-made textile fibers. Style numbers were not submitted. The first is in the shape of mini-golf bag and measures approximately 8” (H) x 4” (W) x 2” (D). The second is in the shape of a mini-backpack and measures approximately 6.5” (H) x 5” (W) x 2” (D). The third is in the shape of a mini-backpack and measures 4” (H) x 3” (W) x 1.5 (D). Each item features a carabineer fastener and is designed for repetitive reuse as well as storage, protection, organization and portability.

The applicable subheading for the carry bags will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides in part, for other bags and containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6% ad valorem.

HTSUS 4202.92.9026 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
