RE: The tariff classification of a bonded fabric consisting of a polypropylene/polyester blend jacquard woven face fabric laminated to a man-made fiber non-woven backing fabric from China.

Dear Mr. Ponthieux:

In your letter dated July 18, 2006 you requested a classification ruling.

The submitted sample, designated as style “Em Crown Blue Lam”, is a bonded mattress ticking fabric composed of a jacquard woven face fabric laminated to a man-made fiber non-woven backing fabric by means of a plastic adhesive which is not visible in cross section. The face fabric is unbleached and is composed of 65% filament polypropylene and 35% filament polyester. It contains 41 single yarns per centimeter in the warp and 16 single yarns per centimeter in the filling. The face fabric is characterized by an intricate woven design featuring a stylized floral motif. The backing fabric which functions to support the face fabric is a dyed man-made fiber non-woven fabric that weighs between 10 and 20 g/m2. Weighing 164 g/m2, the bonded mattress ticking fabric will be imported in 236 centimeter widths. Based on the relative weight, value and function of the component fabrics that form this composite product, it is the jacquard woven face fabric which imparts this item with its essential character.

The applicable subheading for the bonded fabric designated as style “Em Crown Blue Lam” will be 5407.71.0015, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of synthetic filament yarn, including woven fabrics obtained from materials of heading 5404, other woven fabrics, containing 85 percent or more by weight of synthetic filaments, unbleached or bleached, weighing not more than 170 g/m2. The duty rate will be 14.9 percent ad valorem.

This fabric falls within textile category designation 620. At the present time goods that fall within this textile category designation that are produced in China are subject to both quota restraints and visa requirements. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
