RE: The tariff classification of a men’s knit pullover garment from China

Dear Ms. Gu:

In your letter` dated June 2, 2006 and in subsequent information dated July 17, 2006, you requested a tariff classification ruling. As requested, your sample will be returned.

Style 130 is a man’s pullover garment constructed from 100% cotton, jersey knit fabric that measures 24 stitches per 2 centimeters counted in the horizontal direction. The garment will be imported in white and in colors and features a rib knit crew neckline; short, hemmed sleeves; and a straight, hemmed bottom. You state that the fabric weight is 210 grams per square meter.

The applicable subheading for Style 130 will be 6110.20.2069, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men’s or boys’. The duty rate will be 16.5% ad valorem.
