RE: The tariff classification of two women’s garments from China and Vietnam.

Dear Mr. LoPresti:

In your letter dated July 24, 2006, you requested a classification ruling for two women’s garments on behalf of Cherry Stix Ltd. The submitted samples will be returned to you, as requested.

Style CS-8229F is a woman’s romper constructed from 60 percent cotton, 40 percent polyester knit fabric. The romper extends from the shoulders to mid thigh, and has a hood with a draw cord, a V neckline, short sleeves, kangaroo pockets, a draw cord at the waist, and hemmed legs.

Style 7301 is a woman’s bodysuit constructed from 57 percent cotton, 38 percent polyester, and 5 percent spandex knit fabric. The bodysuit has a V neckline, long sleeves, elasticized leg openings, and a snap closure at the crotch.

The applicable subheading for style CS-8229F will be 6114.20.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of cotton: Sunsuits, washsuits, one-piece playsuits and similar apparel: Women’s or girls’. The duty rate will be 10.8% ad valorem.

The applicable subheading for style 7301 will be 6114.20.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of cotton: Bodysuits and bodyshirts. The duty rate will be 10.8% ad valorem.

Style CS-8229F falls within textile category designation 237; style 7301 falls within textile category designation 359.
