RE: The tariff classification of a shawl from China.

Dear Ms. Ramsey:

In your letter dated July 17, 2006, you requested a classification ruling. As requested, the sample will be returned to you.

Your submitted sample, style 25610, is a reversible knit shawl constructed from 100% polyester fiber fabric on both sides. The shawl covers the wearer’s shoulders and waist but does not cover the wearer’s elbows. The shawl features a single button closure near the item’s v-neck and two pockets.

The applicable subheading for style 25610 will be 6117.10.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up clothing accessories, knitted or crocheted; knitted or crocheted parts of garments or of clothing accessories: shawls, scarves, mufflers, mantillas, veils and the like: of man-made fibers. The duty rate will be 11.3 percent ad valorem.

Style 25610 falls within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
