RE: The tariff classification of a man’s knit jacket from China

Dear Mr. Gregory:

In your letter dated July 12, 2006, you requested a classification ruling.

The sample submitted, style W6-007, is a man’s hip-length jacket constructed of a shell composed of contrasting color fabric inserts of a knit 100% polyester fabric that has a visible coating on the inner surface. The jacket is not lined.

The jacket has a full front opening secured by a zipper closure, a stand-up collar and an overlapping flap with four snaps that covers the zipper area. The jacket has long sleeves with elasticized cuffs, a pocket with a zipper closure on the left chest, two front pockets with zipper closures below the waist and a drawcord tightening through the bottom hem.

The sample is being returned to you as you have requested.

The applicable subheading for the jacket will be 6113.00.9025, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Garments, made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907: Other: Coats and jackets: Other: Men’s and boys’. The duty rate will be 7.1 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
