RE: The tariff classification of chair covers from China, Hong Kong and Taiwan.

Dear Ms. Tolchin:

In your letter dated July 14, 2006 you requested a classification ruling on behalf of Save the Chairs! LLC.

The submitted sample is referred to as the “Save the Chairs” Chair Cover. The cover will made from either 100 percent cotton woven fabric, chief weight cotton fabric or chief weight polyester woven fabric. The back of the fabric is coated/laminated with urethane. The two-piece cover is designed slip over the top and bottom portions of a chair. They are secured by means of hook and loop fasteners. The top cover contains a pocket on the back. Another version of the top cover will not contain a pocket.

The applicable subheading for the chair cover (100 percent cotton and chief weight cotton) will be 6304.92.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of cotton. The duty rate will be 6.3 percent ad valorem.

The applicable subheading for the chair cover (100 percent polyester) will be 6304.93.0000, HTS, which other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of synthetic fibers. The duty rate will be 9.3 percent ad valorem.

The cotton and chief weight cotton chair covers fall within textile category designation 369. The polyester chair covers fall within textile category designation 666. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
