RE: The tariff classification of a food ingredient from Malaysia

Dear Mr. Harris:

In your letter dated July 12, 2006, on behalf of Mitsubishi International Food Products, you requested a tariff classification ruling.

Product specifications and a sample were provided with your letter. The sample was examined and disposed of. Friendy MR is a yellow-colored liquid described as a noodle quality improver, imported in 18-kilogram cans. It is said to be composed of sorbitol, vegetable oil, lecithin, glycerol fatty acid esters, and ascorbyl palmitate.

The applicable subheading for this product will be 2106.90.9998, Harmonized Tariff Schedule of the United States (HTSUS), which provides for food preparations not elsewhere specified or includedotherotherother. The rate of duty will be 6.4 percent ad valorem.

This merchandise is subject to The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which is regulated by the Food and Drug Administration (FDA).
