RE: The tariff classification of a women’s upper body garment from China.

Dear Ms. Julia:

In your letter dated July 6, 2006, you requested a classification ruling for a woman’s knit upper body garment. The submitted sample will be returned to you, as requested.

Style F06-08-067 is a woman’s knit upper body garment, which you refer to as a “shrug”, constructed from 80 percent cotton, 20 percent polyester knit fabric. The garment has a detachable, snap-on hood, and long sleeves with cuffs. The garment extends from the neck to the middle of the back, but provides no front coverage.

The applicable subheading for style F06-08-067 will be 6114.20.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of cotton: Other: Women’s or girls’. The duty rate will be 10.8% ad valorem.
