RE: The tariff classification of a man’s pair of ski/snowboard pants from Argentina

Dear Mr. Grandkoski:

In your letter dated June 22, 2006, you requested a classification ruling.

The sample submitted, style number 07 “Snow Pant,” is a man’s pair of ski/snowboard pants constructed of a shell composed of a woven 100% nylon fabric that has a visible polyurethane coating on the inner surface and sealed seams at the front and back rise. The garment is lined with a woven nylon taffeta fabric and has brushed knit polyester tricot fabric inserts at the knee area, on the upper portion of the rear panels and on the inner portion of the waistband.

The garment is a man’s pull-on pair of pants with a fly front opening secured by a zipper closure with no opening on the waistband. The waistband features four belt loops, a plastic buckle on each side seam and an elasticized rear belt that has a hook and loop fastener at each end and is partially covered by a self-fabric tunnel in the rear. The garment has a powder gaiter with a drawcord tightening on the inner portion of the waist area, a zippered right pocket below the waist, two side seam zipper openings with a mesh fabric gusset along the length of each thigh area, long hemmed pants legs that have quilting and a zipper opening with a gusset at the ankle area, and hidden leg sleeves with an elastic tightening at the ankle area.

The sample is being returned to you as you have requested.

The applicable subheading for the ski/snowboard pants will be 6210.40.5031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: Other men’s or boys’ garments: Of man-made fibers: Other: Trousers, breeches and shorts: Ski/snowboard pants. The duty rate will be 7.1 percent ad valorem.
