RE: The tariff classification of a thermal circuit breaker from Mexico.

Dear Mr. Averill:

In your letter dated June 22, 2006, you requested a tariff classification ruling on behalf of your client Airpax Corporation of Frederick, Maryland.

The merchandise under consideration is an ATR (Ambient Temperature Range) thermal circuit breaker. Two samples identified as “ATR11 WY 6315.0A” were submitted to this office, in addition to the literature, for classification purposes. The samples are rated for 15 amps and 240 volts. The thermal circuit breakers consists of an insulated plastic housing measuring approximately ¾” wide by ½” high and is 1” deep with a red colored reset button on one end and two spade terminals on the opposite end. As indicated in the literature submitted to this office, the ATR circuit breaker is a single pole thermally operated overload protector with a snap acting trip mechanism that provides reliable trip free operation on current overloads. Typical applications for this merchandise include power strips, single phase–motors, transformers, solenoids, UPS (Uninterruptible Power Supplies), etc.

The applicable subheading for the ATR thermal circuit breaker will be 8536.20.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Automatic circuit breakers: Molded case.” The general rate of duty will be 2.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
