RE: The tariff classification of a women’s jacket from China or Vietnam

Dear Mr. McManus:

In your letter dated June 21, 2006, on behalf of your subsidiary, Prominent USA LLC, you requested a classification ruling. A sample was submitted and is being returned as you requested.

The item in question, style 367AL, is a women’s jacket made from a 100% polyester knit fabric with a polyurethane and polyvinyl chloride coating that is covered on the outer surface with rayon flock. The jacket has a full front opening with a five-button, right-over-left closure, long, vented sleeves with a buttoned cuff, a banded bottom and a banded collar treatment. The garment is unlined and is approximately 21-inches in length.

The applicable subheading for the jacket will be 6113.00.9030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s or girls’ coats and jackets made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907, other than of cotton. The duty rate will be 7.1 percent ad valorem.

This jacket falls within textile category designation 635. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
