RE: The tariff classification of socks from China, Vietnam and Japan.

Dear Ms. Dyer:

In your letter dated June 21, 2006, on behalf of Uniqlo USA, Inc., you requested a classification ruling. As requested, the sample will be returned to you.

The submitted sample is a Style # 04366F059A/B/C/F below-the-knee length sock; the different suffixes represent different color socks. You state the sock is constructed of woven 100% polyester fleece fabric. However, examination reveals the sample to be of knit construction. It consists of three panels sewn together with a band at the opening to hold the sock in place. The item is the type commonly worn for warmth inside footwear. You will also be importing a Style # 4366F058B/C/F/GT, which is identical to the below-the-knee sock except it will be ankle-length.

The applicable subheading for the socks, Style #’s 04366F059A/B/C/F and 4366F058B/C/F/G will be 6115.93.9020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for panty hose, tights, stockings, socks and other hosieryknitted or crocheted: other: of synthetic fibers: other: other: other. The duty rate will be 14.6 percent ad valorem.

Style #’s 4366F058B/C/F/G and 04366F059A/B/C/F fall within textile category designation 632.
