RE: The tariff classification of a charm and a pin from China

Dear Mr. Barone:

In your letter dated June 27, 2006, you requested a tariff classification ruling on behalf of Lesilu Productions and Hey Doll.

The samples you provided are a cell phone charm, SKU number 0430450131, and a metal pin, SKU number 0377750136. Each item is packaged for retail sale with a paper card that indicates the phrase, “Taking Steps to Fight Breast Cancer,” on the front, and provides a $5.00 discount coupon for a purchase of $25.00 at Payless Shoe Source on the back.

The cell phone charm consists of a 3-½ inch long, pink plastic strap; two small, base metal charms; and a 2-inch textile loop that attaches to the phone. One charm is in the shape of a shoe, the other looks like a pink breast cancer ribbon.

The base metal pin resembles a pink breast cancer ribbon with a shoe charm dangling from it. It measures approximately 2-¼ inches long and is intended to be worn as personal adornment.

The applicable subheading for the cell phone charms will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bells, gongs and the like, nonelectric, of base metalstatuettes and other ornaments, and parts thereof, other. The rate of duty will be free.

The applicable subheading for the pin will be 7117.19.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for imitation jewelry, of base metal, whether or not plated with precious metal, other, other, other. The rate of duty will be 11 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
