RE: The tariff classification of a woman’s jacket from Vietnam

Dear Ms. Mangusa:

In your letter dated June 9, 2006, you requested a classification ruling.

The sample submitted, style number H26386, is a woman’s hip-length jacket constructed of a shell composed of a woven crinkle 60% polyester/40% nylon fabric. The jacket is lined with a woven 100% polyester fabric and has a nonwoven polyester batting fill.

The jacket features embroidery stitching in the form of flowers and stems over the entire surface of the shell fabric, a full front opening secured by a double pull zipper closure, a fold down collar that is composed of a fake fur 100% acrylic fabric on the outer portion of the collar, two front in-seam pockets at the waist and a straight cut hemmed bottom.

The sample is being returned to you.

The applicable subheading for the jacket will be 6202.93.5011, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s anoraks (including ski jackets), windbreakers and similar articles: of man-made fibers: other. The duty rate will be 27.7 percent ad valorem.

The jacket falls within textile category designation 635. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
