RE: The tariff classification of stainless steel flexible tubing from Italy.

Dear Mr. Zupito:

In your letter dated May 12, 2006, on behalf of your client Nippon Express Co., you requested a tariff classification ruling. A representative sample was submitted with your request.

The product to be imported is described as stainless steel cable for use in a power steering assembly. This flexible metal tubing is imported on spools in material lengths. After importation, the tubing is cut to a specific length, encased in plastic and fitted with end caps or metal fittings. This protective jacket will ultimately be used to house a power steering hose which carries hydraulic fluid to the power steering pump.

The applicable subheading for the stainless steel flexible tubing will be 8307.10.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for flexible tubing of base metal, with or without fittings, of iron or steel, other. The rate of duty will be 3.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
