RE: The tariff classification of badge holders from China

Dear Mr. Crook:

In your letter dated May 23, 2006, you requested a tariff classification ruling for badge holders, on behalf of Global Traders & Suppliers, Inc.

The samples submitted were not identified with style numbers. The items are badge holders for use as a means of identification. They are manufactured with an exterior surface of man-made fiber textile material coated with polyvinyl chloride (PVC) on the inside. They measure approximately 4½”(W) x 5½”(H) with an adjustable braided strap, which allows the user to hang the holder from the neck. The holder features a clear front pocket for the ID, a rear zippered pocket to hold a pad or other stationery items and a penholder loop. Your samples are being returned.

The applicable subheading for badge holders will be 4202.32.9550, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of textile materials, other, other, of man-made fibers. The rate of duty will be 17.6% ad valorem.

The badge holders fall within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the "Textile Status Report for Absolute Quotas" available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
