RE: The tariff classification of a woman’s pullover from Lesotho

Dear Ms. Pudjijanto:

In your letter dated June 7, 2006, you requested a classification ruling. Your sample is being returned.

The submitted sample, style “Gap Red”, is a woman’s cut and sewn pullover that is constructed from 100% cotton knit fabric. The outer surface of the fabric measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The garment features a scoop neckline, short hemmed sleeves and a hemmed bottom.

The marking statute, section 304, Tariff Act of 1930, as amended (19 U.S.C. 1304), provides that, unless excepted, every article of foreign origin (or its container) imported into the United States shall be marked in a conspicuous place as legibly, indelibly and permanently as the nature of the article (or its container) will permit, in such a manner as to indicate to the ultimate purchaser in the U.S. the English name of the country of origin of the article. The proposed stamped country of origin label located on the back panel just below the neckline is readily visible to the ultimate purchaser and constitutes an acceptable country of origin marking.

The applicable subheading for the pullover will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pullovers, knitted: of cotton: otherother: women’s. The duty rate will be 16.5% ad valorem.

The pullover falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
