RE: The tariff classification of a pullover jacket from Macau and China

Dear Ms. Stubblefield:

In your letter dated June 1, 2006, you requested a classification ruling.

The sample submitted, style number 3260 “Taffeta Windshirt/Mesh Lined,” is a man’s hip-length pullover jacket constructed of a shell composed of a woven 100% nylon fabric that has a polyurethane coating. The garment is lined with a mesh fabric in the body and with a woven man-made fiber fabric in the sleeves. The man’s jacket will be imported in sizes S to 3XL. The same jacket will also be imported under style number 3261 in boy’s sizes S to L.

The coating is not visible as that term is defined in the tariff, therefore HTS 6210 does not apply.

The jacket has a cross over v-neck style collar composed of a ribbed-knit fabric, long sleeves with ribbed-knit fabric cuffs, two side seam pockets at the waist and a ribbed-knit fabric bottom hem.

The sample is being returned to you.

This garment is eligible for classification as water resistant. If styles 3260 and 3261 pass the water resistance test specified in the Harmonized Tariff Schedule of the United States (HTSUS), Chapter 62, U.S. Note 2, then the applicable HTS subheading will be 6201.93.3000, which provides for other men's or boys’ anoraks, windbreakers and similar articles of man-made fibers, water resistant. The duty rate will be 7.1 percent ad valorem.

If style 3260 does not pass the water resistance test, then the applicable HTS subheading for the garment will be 6201.93.3511, which provides for other men's anoraks, windbreakers and similar articles of man-made fibers. The duty rate will be 27.7 percent ad valorem.

If style 3261 does not pass the water resistance test, then the applicable HTS subheading for the garment will be 6201.93.3521, which provides for other boys’ anoraks, windbreakers and similar articles of man-made fibers. The duty rate will be 27.7 percent ad valorem.

Both styles 3260 and 3261 fall within textile category designation 634. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
