RE: The tariff classification of a plastic photo album from China.

Dear Ms. Marcoux:

In your letter dated June 1, 2006, you requested a classification ruling.

The submitted illustration depicts a Pop-Up Photo Album identified as item number 56760. This album holds two panels of 6 double-sided photo sleeves and 2 additional stand-up sleeves. The cascading photo pockets accommodate 4” by 6” or 3” by 5” photographs. The stand-up sleeves accommodate two cropped photos. Photos can be slipped into plastic sleeves to keep them protected from fingerprints.

The album covers are made of cardboard that is covered with cotton fabric. The plastic sleeves are made of polypropylene. This photo album measures approximately 7-1/8 inches long by 6-3/4 inches wide by ¾ inch high when folded.

The applicable subheading for the photo album with plastic sleeves will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTSUS), which provides forother household articlesof plastics: other: other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
