RE: The tariff classification of a mounting kit for an air conditioning unit of unspecified origin

Dear Ms. Sousa:

In your letter dated May 25, 2006 you requested a tariff classification ruling.

The article in question is described as a “Baying Kit” which is used to join a “NetShelter Enclosure” to a “NetworkAir Module”. The NetShelter Enclosure is essentially an enclosure for electronic equipment, while the NetworkAir Module is an air conditioning unit designed to cool the electronic equipment housed within the NetShelter. The Baying kit is comprised of metal trim pieces and the fasteners necessary to mount the air conditioning unit to the equipment enclosure.

The applicable subheading for the Baying kit will be 8415.90.8085, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other parts of air conditioning machines. The general rate of duty will be 1.4 percent ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Kenneth T. Brock at 646-733-3009.

Sincerely,
