RE: The tariff classification of a woman’s upper body garment from Israel.

Dear Ms. Rizzo:

In your letter dated June 7, 2006, you requested a classification ruling for a woman’s knit top. The submitted sample will be returned to you, as requested.

Style 27004 is a woman’s top constructed from 95 percent nylon, five-percent spandex knit fabric. The pullover has a capped V neckline, long sleeves, and a hemmed bottom. The garment extends just below the bust.

The applicable subheading for style 27004 will be 6114.30.1020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of man-made fibers: Tops: Women’s or girls’. The duty rate will be 28.2% ad valorem.

Style 27004 falls within textile category designation 639. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
