RE: The tariff classification of four nonwoven waxing strip products, from China.

Dear Ms. Ritchings:

In your letter dated June 2, 2006, which was a follow-up to an earlier inquiry where we requested additional information, you requested a tariff classification ruling. The manufacturer is Millplan Industries Ltd., Guang Dong, China.

Four representative samples were submitted which were identified as follows:

SSWA07 Satin Smooth Non-Woven Cloth Waxing Strips SSWA08 Satin Smooth Non-Woven Cloth Waxing Strips SSWA09 Satin Smooth Non-Woven Cloth Roll
SSWA11 Satin Smooth Waxing Strips and Applicator Kit

According to your correspondence, all of the nonwoven cloths, whether packaged in squares, rectangles or rolls, are composed of filament man-made fibers (70% polyester/30% viscose) that have been hydro entangled to bond together. You state that the fabrics weigh 75 grams per square meter. With respect to style SSWA11, this item contains the wooden applicator sticks in addition to the waxing strips, themselves. As such, it is considered to be a set with the essential character imparted by the nonwoven waxing strips. The wooden applicator sticks are disposable after use.

The applicable subheading for all of these products will be 5603.13.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for nonwovens whether or not impregnated, coated, covered or laminated, of man-made filaments, weighing more than 70 g/m² but not more than 150 g/m². The duty rate will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
