RE: The tariff classification of Christmas decorations from China.

Dear Ms. Aldinger:

In your letter dated May 10, 2006, you requested a classification ruling.

The submitted samples are identified as Iron Figurine, assortment number 945751. This product is an iron Christmas figurine in a chrome-plated finish. It will be available in three assorted styles: Snowman, Santa and Christmas tree. The decorated Christmas tree has a star on the top. The snowman is wearing a Santa hat and holding the word “JOY” that extends across the front from one hand to the other. The three assorted figures are considered to be decorative figures of the Christmas holiday season.

The applicable subheading for the Iron Figures, assortment number 945751, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free.
