RE: The tariff classification of a woman’s sleep pant from China

Dear Ms. Pate:

In your letter dated May 5, 2006, you requested a classification ruling on behalf of Kayser-Roth Corporation. The submitted sample will be returned to you as requested.

Style PJ40075 is a woman’s pajama pant constructed from 100 percent cotton woven fabric. The garment features an elasticized drawstring waist, a printed design and capri length legs. Based on appearance, as well as the merchandising information provided, the style is considered sleepwear and classified in heading 6208, HTS.

The applicable subheading for the style PJ40075 will be 6208.91.3010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: other: of cotton: other: women’s. The duty rate will be 11.2 percent ad valorem.
