RE: The tariff classification of a scarf from China.

Dear Mr. Stack:

In your letter dated May 15, 2006, you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, PP 1039614, Cold Weather Scarf, is a rectangular-shaped scarf composed of knit 70% acrylic/30% wool fabric with fringe on both ends. The scarf measures approximately 14” in width and 56” in length.

The applicable subheading for style SC6091JU5 will be 6117.10.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other made up clothing or accessories, knitted or crocheted; knitted or crocheted parts of garments or clothing accessories: Shawls, scarves mufflers, mantillas, veils and the like: Of man-made fibers, Containing 23 percent or more by weight of wool or fine animal hair.” The duty rate will be 11.3 percent ad valorem. The textile category designation is 459.
