RE: The tariff classification of a women’s tank-style blouse from China

Dear Mr. Stack:

In your letter dated May 10, 2006, you requested a tariff classification ruling on behalf of Item Eyes, Inc. The submitted sample will be returned to you, as requested.

Style 61880T is a women’s tank-style blouse constructed from 97% cotton and 3% spandex woven fabric. The sleeveless blouse measures approximately 2 inches across the shoulder seams. The garment features a U- shaped front neckline, a full front opening secured by eight closely spaced buttons, overlays at the side simulating buttoned tabs, contrasting colored trim in the seams and a back flap insert at the garment bottom. Although you refer to the garment as a vest, it provides sufficient coverage to be worn alone.

The applicable subheading for style 61880Twill be 6211.42.0056, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Track suits, ski-suits and swimwear; other garments: Other garments, women’s or girls’: Of cotton: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206, Other. The duty rate will be 8.1 percent ad valorem.
