RE: The tariff classification of a woman’s pullover from Hong Kong

Dear Ms. Masternak:

In your letter dated May 11, 2006, on behalf of TravelSmith Outfitters (IOS division), you requested a tariff classification ruling. Your sample is being returned as requested.

The submitted sample, style number 603211, is a woman’s knit sleeveless pullover. The outer surface of the garment measures more than 9 stitches and less than 18 stitches per 2 centimeters in the direction the stitches were formed. The pullover features a round neckline and a self-start bottom. You did not submit the capping component, but since the front and back panels lack continuous lines of demarcation the garment is not knit to shape and does not meet the requirements of Chapter 61, Note 6 of the 2006 Harmonized Tariff Schedule of the United States (HTSUS).

You included a lab test with this letter. The lab reports that the fabric of this style is composed of two yarns. The first yarn is composed wholly of 63% rayon, 37% nylon. The second yarn is composed wholly of 65% rayon, 35% metallic (31.9% polyester, 3.1% metal). The relative weight by percentage of the first yarn is 78.8% and the second yarn, 21.2%. The overall fiber content of the garment is 64% rayon, 28.7% nylon, 7.3% polyester (metallized).

Please note that a yarn that contains any amount of metal is regarded in its entirety as “metallized yarn” for tariff purposes. Thus, the determination of which textile material predominates by weight is based not on the actual weight of metal, but on the actual weight of all yarns that contain metal.

The applicable subheading for the pullover will be 6110.30.3059, (HTSUS), which provides for pullovers, knitted: of manmade fibers: otherother: women’s: other. The rate of duty will be 32% ad valorem.

The pullover falls within textile category designation 639. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
