RE: The tariff classification of woman’s pullover from China.

Dear Mr. Evan:

In your letter dated May 3, 2006, on behalf of Bernard Chaus, Inc., you requested a classification ruling. As requested, the sample will be returned to you.

Your submitted sample, Style GDY15024 is a woman’s pullover. The garment is constructed of 64% silk and 36% nylon knit fabric with more than 9 stitches per 2 centimeters. The cut and sewn pullover features long sleeves with hemmed cuffs, a deep V-neckline and a wrap appearance at the front. The garment is lined with 100% nylon knit fabric.

The applicable subheading for style GDY15024 will be 6110.90.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of other textile materials: other: other: other: women’s or girls’. The duty rate will be 6 percent ad valorem.
