RE: The tariff classification of an infant costume from China.

Dear Ms. Navidad:

In your letter dated April 27, 2006, you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, style 5549 Eeyore Infant Costume is a jumpsuit made of velour knit 100% polyester fabric. The long sleeve jumpsuit has an attached hood with long ears, and full front snap closure. The well-made jumpsuit has a finished neckline and seams, styling and embellishments. The Eeyore will be imported in sizes 0-6 months and 12-18 months.

The applicable subheading for the Eeyore Costume, style 5549 will be 6111.30.5070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Babies’ garments and clothing accessories, knitted or crocheted: Of synthetic fibers: Other, Other: Other." The duty rate will be 16% ad valorem. The textile category designation is 239.
