RE: The tariff classification of an Enchanting! Dress Up Trunk from China.

Dear Ms. Beals:

In your letter dated May 3, 2006, you requested a tariff classification ruling.

You submitted an Enchanting! Dress Up Trunk identified as style number 64010 that consists of a pink polyester tricot top, pink skirt, a cape made of acrylic and polyester with olefin backing and faux fur, a blue dress of poly velvet and poly tricot, a lavender dress made of poly velvet with poly satin and nylon lace, a tiara, plastic shoes, a plastic bead necklace and a plastic bracelet packaged together inside a cardboard trunk. Although all the garments have styling features, the preponderance of their elements are flimsy and impart the essential character of the trunk.

The applicable subheading for the Enchanting! Dress Up Trunk identified as style number 64010 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS) which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free.
