RE: The tariff classification of crabmeat from Mexico.

Dear Ms. Smith:

In your letter dated April 20, 2006, on behalf of your client Phillips Foods Incorporated, you requested a tariff classification ruling.

The merchandise is described as 100 percent Blue Crab crabmeat (Callinectes sapidus) and (Callinectes bellicosus) that will be picked, cooked and treated with high hydrostatic pressure (80,000 lbs / square inch) to eliminate pathogens and extend shelf life for up to 19 days. You indicate that the product will be packed in “oxygen permeable” film packaging (4.5” x 5” x 1.75”) and will be shipped under refrigeration at a degree range of 30° to 38° F.

The applicable subheading for the crabmeat will be 1605.10.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Crustaceans, molluscs and other aquatic invertebrates, prepared or preserved, other, crabmeat, other, other. The rate of duty will be 5 percent ad valorem.

This merchandise is subject to The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which is regulated by the Food and Drug Administration (FDA). This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
