RE: The tariff classification of chef coats from Guatemala.

Dear Ms. Harwell:

In your letter dated April 24, 2006, you requested a tariff classification ruling. The samples will be returned to you as requested.

Three samples of unisex chef coats consisting of woven 100% cotton were submitted with your request.

Style 0402C is a hip length chef’s coat with a mandarin collar, left breast pocket, a pocket on the sleeve and a full front double breasted button closure that closes left over right and right over left.

Style 0425C is a hip length chef’s coat with a mandarin collar, left breast pocket, a pocket on the sleeve and a full front double breasted ¾” braided button closure that closes left over right and right over left.

Style 0403C is identical to style 0425C with the exception of a smaller ½” braided button.

The applicable subheading for the chef coats, styles 0402C, 0425 and 0403 will be 6206.30.3040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women's or girls' blouses, shirts and shirt-blouses: Of cotton: Other: Other, Other: Women's. The duty rate will be 15.4% ad valorem."

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
