RE: The tariff classification of a ladies’ cardigan from China

Dear Mssrs:

In your letter dated April 21, 2006, written on behalf of Ann Taylor, Inc., you requested a classification ruling.

Submitted style 149061, manufactured from finely knitted fabric of 64% rayon/36% nylon, is characterized by long sleeves, a round neckline, and a full-front opening, secured by hook and eye closures. All of the components of this garment are knit to shape and assembled by linking and looping.

As you have requested, the sample garment and its accompanying component parts are being returned.

The applicable subheading for this style will be 6110.30.3057, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweatersand similar articles, knitted, of man-made fibers, other, other, other, other, other, women’s, knit to shape articles described in statistical note 6 to this chapter. The duty rate will be 32 percent ad valorem.
