RE: The tariff classification of three decorative lead crystal paperweights from China

Dear Ms. Marcoux:

In your letter dated April 6, 2006, you requested a tariff classification ruling. Three representative samples were submitted with your ruling request.

The product in question is described as “Diamond Ring Paperweight” – item numbers 55080/Blue Circle Stone, 55082/Clear Circle Stone and 55084/Pink Heart Stone. The item is a lead crystal paperweight that resembles a diamond ring. It will be imported in a blue or clear round glass stone or a pink heart-shaped glass stone. The measurements for each paperweight are approximately four inches in height by three inches in diameter.

You indicated in your letter that each glass stone (blue, clear and pink) contains 24 percent lead monoxide by weight. The ring setting for each lead crystal stone is composed of 100% copper with imitation rhodium plating.

You stated in your letter that the unit value of each lead crystal paperweight is over five dollars each.

The applicable subheading for the three lead crystal paperweights will be 7013.91.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes...: other glassware: of lead crystal: valued over $5 each. The rate of duty will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
