RE: The tariff classification of key ring and flower kits from China

Dear Mr. Yi:

In your undated letter that was received by this office on April 11, 2006, you requested a tariff classification ruling on behalf of your client, Fibre-Craft Materials Corporation, of Niles, Illinois.

The samples you submitted are two Back Pack Buddies Pom kits (item numbers 2140 and 2141), and one Flower kit (item number 7109). The Back Pack Buddies Pom kits each contain four steel split rings with short chains, wiggle eyes, poms, chenille pieces, and felt ears. Children will assemble the components of the kits into key rings with small animal figures attached. Item number 2140 will make 4 kitty key rings and item number 2141 will make 4 puppy key rings.

The applicable subheading for the kitty and puppy key ring kits will be 7326.20.0070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of iron or steel wire, other. The duty rate will be 3.9 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on item number 7198, the flower kit. Your request for a classification ruling should include the answers to the following questions.

How is the flower kit intended to be used? Who will use it?

What do you make with the kit? What is the end product?

Please provide a breakdown of all the components in the kit.

When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.
