RE: The tariff classification of women’s halter-styled garment from China

Dear Ms. Dairo:

In your letter dated May 3 2006, you requested a classification ruling. A sample was submitted and is being returned as you requested.

Style 8212-6 is a women’s halter-styled upper body garment constructed from 40% cotton, 37% polyester, 19% rayon and 4% spandex woven fabric. The sleeveless, tailored garment is lined and features a notched lapel, a deep V-neckline, two inset pockets at the waist and a full front opening with a two button closure. The front panels extend into a halter that is worn around the neck, leaving the arms, shoulders and most of the back bare.

The applicable subheading for style 8212-6 will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: other. The duty rate will be 16 percent ad valorem.
