RE: The tariff classification of a woman’s shirt from Vietnam.

Dear Mr. Stack:

In your letter dated March 31, 2006, you requested a classification ruling on behalf of Item Eyes, Inc. The provided sample will be returned as per your request.

Style 47129K is a woman’s short sleeve shirt constructed of a 95% rayon 5% spandex knitted fabric. The fabric of the shirt has more than 10 stitches per centimeter counted in both the horizontal and vertical directions. The knitted fabric shirt features a v-neck front into which is sewn a woven fabric insert consisting of a two button front opening at the chest area and a pointed collar. The insert gives the appearance of a 2-layer garment. The garment also features self-fabric trim at the sleeves and garment bottom.

The applicable subheading for the garment will be 6106.20.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s or girls’ blouses and shirts, knitted or crocheted, Of man-made fibers, Women’s. The rate of duty will be 32% ad valorem.
