RE: The tariff classification of a woman’s blazer from China

Dear Ms. De Silva:

In your letter dated March 30, 2006, you requested a classification ruling. The submitted sample will be returned to you as requested.

Reference PP 349504 is a woman’s woven blazer constructed from 97 percent cotton and 3 percent spandex corduroy fabric. The tailored jacket is made from more than four panels sewn together lengthwise and features long sleeves, a notched collar, two pockets at the waist, a full front opening secured by two buttons and a rear center vent. The jacket is embellished with an embroidered design on the upper right panel and on the left pocket.

The applicable subheading for the jacket will be 6204.32.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-type jackets and blazers: of cotton: other: corduroy: women’s. The duty rate will be 9.4 percent ad valorem.

The jacket falls within textile category designation 335. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
