RE: The tariff classification of a men’s knit muscle shirt from Macau.

Dear Ms. Parker:

In your letter dated March 30, 2006, you requested a tariff classification ruling. As requested, your sample will be returned.

Style 51000 “Men’s Sleeveless Training Tee”, is a men’s muscle shirt constructed from 90% polyester, 10% spandex, finely knit fabric that measures 28 stitches per two centimeters counted in the horizontal direction. Style 51000 is sleeveless and features a crew neckline; armholes finished with capping that has been hemmed and cut; and a straight front bottom with a rear tail, that has been hemmed and cut.

The applicable subheading for Style 51000 will be 6110.30.3053, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: men’s or boys’. The rate of duty is 32% ad valorem.
