RE: The tariff classification of a man’s padded sleeveless jacket from China

Dear Mr. Gregory:

In your letter dated March 23, 2006, you requested a classification ruling.

The sample submitted, style number J5-271, is a man’s hip-length padded sleeveless jacket. The garment is constructed of a shell composed of a woven 228T ripstop 100% nylon taslan fabric that is quilted to a nonwoven polyester batting fill. The garment is lined with a woven 210T 100% nylon fabric.

The padded sleeveless jacket has oversized armholes, a stand-up collar, a full front opening secured by a zipper closure that extends to the top of the collar and an overlapping flap that covers the zipper area. The garment has two vertical front pockets and an elasticized waistband. The “Fort Dodge Innovator Vaccines” tradename and logo is on the left chest and on the rear portion of the collar.

The sample is being returned to you as you have requested.

The applicable subheading for the padded sleeveless jacket will be 6201.93.2020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’ padded, sleeveless jackets: of man-made fibers: other. The duty rate will be 14.9 percent ad valorem.

The padded sleeveless jacket falls within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
