RE: The tariff classification of a man’s jacket from Bangladesh

Dear Ms. West:

In your letter dated March 30, 2006, you requested a classification ruling.

The sample submitted, style number 28033, is a man’s hip-length jacket constructed of a shell composed of a woven peached 100% cotton canvas fabric. The jacket is lined in the body with a brushed heavy knit micro-fleece fabric and in the sleeves with a woven nylon fabric that is quilted to a nonwoven polyester batting fill.

The jacket has a fold-down spread collar, a full front opening secured by a left-over-right, seven button closure and two chest pockets with two metal rivets at the opening of each pocket. The garment also has long vented sleeves with a button closure on the vent opening, an adjustable button closure on the cuffs, and a shirt-style bottom hem.

The sample is being returned to you as you have requested.

The applicable subheading for the jacket will be 6201.92.2051, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other men’s anoraks, windbreakers and similar articles: other: of cotton. The duty rate will be 9.4 percent ad valorem.

The jacket falls within textile category designation 334. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
